"Update from Brussels – the new and revised TTBER"

The new and revised Technology Transfer Block Exemption Regulation (TTBER) and the corresponding Guidelines have been published on April 16 with with a clear focus on data and standard-essential technologies.
Key changes include: new guidance on data licensing for production purposes; a new section on licensing negotiation groups (LNGs) (how to distinguish genuine joint negotiations from buyer cartels and how to mitigate Article 101 risk); simplified application of market-share thresholds where licensing happens before the technology is commercialised; and tighter, more specific conditions for the Guidelines’ safe harbour for technology pools, to ensure it is limited to pools compliant with Article 101 TFEU.
The new rules take effect on May 1, 2026. With our LES Wednesday Talk on May 13 this is a perfect time for an update directly from the EU Commission. LES Germany is honored that Magdalena Popiolek and Marco Vischi from DG Comp will present the new and revised TTBER for our members.
